## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | From the documents the lawyer selects, list the person who died or was injured, each person said to have suffered loss because of the injury or death, and whether the file describes a business or professional relationship with the injured person. Do not write the advice and do not name a state dependency statute. |
| What the lawyer must review | Decide who may claim under s 138(3), s 139 and s 145. The lawyer writes the advice. Do not use section 139 for loss from a business or professional relationship. Do not name a state death or survival section. Those laws are picked up and their sections were not opened. Keep health and wage records in a firm-controlled tool. |

## Checking plan

**Lawyer-led judgement**

The lawyer writes the advice on who may claim and which state statute is picked up.

- What the AI does: From the documents the lawyer selects, list the person who died or was injured, each person said to have suffered loss because of the injury or death, and whether the file describes a business or professional relationship with the injured person. Do not write the advice and do not name a state dependency statute.
- What the lawyer does: Decide who may claim under s 138(3), s 139 and s 145. The lawyer writes the advice. Section 139 does not cover loss that comes about because of a business or professional relationship. State death-liability and survival laws are picked up. Their sections were not opened, so none is named. Keep health and wage records in a firm-controlled tool.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance. The Commonwealth text opened was the AustLII consolidation.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Keep s 138(3) (the injured person has died) separate from s 139 (a different person suffers loss because of the injury or the death).
2. Exclude a loss that comes about because of a business or professional relationship between the claimant and the injured person.
3. Do not name a state fatal-accidents or survival section that has not been opened.
4. Do not finish the personal-representative discoverability rule in s 87G(6) from an incomplete reading.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
