## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the injury facts and the dates the lawyer supplies, list the pre-court steps in the sections opened, with the date each step falls due and the document each step asks for, and leave a step off the list where no section opened for that forum requires it. Do not draft the notice. |
| What the lawyer must review | The lawyer decides which steps apply, who receives them, and whether any excuse for delay is made out. The tool does not draft the notice. The lawyer completes any verification the approved form requires. Health information stays in a firm-controlled tool, not a public one. Check that a Queensland part 1 notice still needs the specialist report in section 9A(9)(d). |

## Checking plan

**Source-by-source verification**

Trace relied-on content to the opened sections and check for a difference the table has missed.

- What the AI does: From the injury facts and the dates the lawyer supplies, list the pre-court steps in the sections opened, with the date each step falls due and the document each step asks for, and leave a step off the list where no section opened for that forum requires it. Do not draft the notice.
- What the lawyer does: The lawyer decides which steps apply, who receives them, and whether any excuse for delay is made out. The tool does not draft the notice. The lawyer completes any verification the approved form requires. Health information stays in a firm-controlled tool, not a public one. A Queensland part 1 notice still needs the specialist report in section 9A(9)(d).
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. For a Queensland medical incident, list the initial notice, the one-month document response, and the part 1 notice with the specialist report, in that order.
2. Do not apply the ordinary section 9(3) part 1 time limit to a claim to which section 9A applies.
3. If the proposed defendant is the State, name the health service chief executive for the initial notice where section 9A(7)(a) applies, and the Crown solicitor for part 1.
4. Do not describe the Victorian significant-injury condition, or the New South Wales 15 per cent condition, as a notice that must be served before filing.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Health information stays in a firm-controlled tool. Rule 9.1 of the Legal Profession Uniform Law Australian Solicitors' Conduct Rules 2015, as described by the Victorian Legal Services Board and Commissioner, and APP 11, apply. The lawyer decides whether any loss is notifiable under the Privacy Act 1988 (Cth).
- Section 9(1B) says the approved form may require verification. The lawyer completes that part. The tool writes nothing in it.
