| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | In a firm-controlled tool, list the authorities the lawyer says the client must sign so the firm can collect treatment and wage records, and note that a Medicare recovery may arise later. The tool does not complete a notice of judgment or settlement, and it does not complete a scheme authority. |
| What the lawyer must review | Choose the authorities yourself. The client signs them. Do not complete a WorkSafe medical-information authority, or a Medicare notice of judgment or settlement. Keep treatment records in a firm-controlled tool. ASCR r 9 and APP 11 apply. |

## Checking plan

**Verify against sources**

The lawyer chooses the authorities. The list separates the firm's authority from a WorkSafe form and from a later Medicare notice.

- What the AI does: In a firm-controlled tool, list the authorities the lawyer says the client must sign so the firm can collect treatment and wage records, and note that a Medicare recovery may arise later. The tool does not complete a notice of judgment or settlement, and it does not complete a scheme authority.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Keep the firm's authority separate from any scheme form. The client signs what the lawyer has chosen.
2. On a WorkSafe claim other than a death claim, section 20(3) requires a signed authority. Do not complete it.
3. Record that a Medicare notice may be required later. Do not complete the notice of judgment or settlement, and do not release a payment.
4. Do not collapse the page's judgment test and settlement test into one dollar rule. The lawyer reads both.

## Notes

- The firm's authority to collect treatment and wage records is separate from a scheme form. Workplace Injury Rehabilitation and Compensation Act 2013 section 20(3): a claim for compensation, other than a claim arising from the death of a worker, must include an authority signed by the worker. The authority lets a provider of a medical service or hospital service give the Authority, self-insurer or employer information about the service relevant to the claim. Do not complete that authority. State health-records legislation was not opened.
- The Services Australia page is Commonwealth and applies in Victoria. A notifiable person must tell the agency in writing where a compensation amount of more than $5,000 was fixed by judgment or settlement under Australian law, including legal costs for settlements, or a reimbursement arrangement was made more than 6 months after a claim was lodged. The payer completes a notice of judgment or settlement within 28 days. The same page says notice is not required if the claim settled for less than $5,000 including all costs, or if within 6 months of the claim there is a reimbursement arrangement for medical expenses. A later part of the page separates a judgment that fixes compensation at more than $5,000 not including costs from a settlement that fixes it at more than $5,000 including all costs. This list records that the recovery may arise. It does not give the notice. The lawyer checks which limb applies.
- Keep health, wage and scheme records in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victoria: authorities to collect treatment and wage records, with a Medicare flag

**Deliverable**: A list of authorities for the client to sign, plus a note that a Medicare recovery may arise and is not done here.

**Inputs**

- The records the lawyer wants collected
- Whether a WorkSafe claim is being lodged
- The lawyer's choice of authority wording

**Example**: Illustrative example: The lawyer wants hospital records and payslips. The list has a firm authority for the client to sign, and a line that a WorkSafe medical authority is not completed by the tool. No Medicare notice is prepared.

**Stop and escalate when**

- The tool would complete or sign an authority.
- The tool would lodge a Medicare notice of judgment or settlement.
