## Checking plan

**Verify against sources**

The list is of authorities the client signs for the firm. Scheme notices and the Medicare notice are separate.

- What the AI does: List the authorities the lawyer says the client must sign so the firm can collect treatment and wage records. A Medicare recovery may arise later. Do not complete a notice of judgment or settlement, and do not tell either insurer that both claims have been made.
- What the lawyer does: Choose the authorities and arrange for the client to sign them.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The firm's authority to collect treatment and wage records is the client's instruction to the firm. It is not a claim form under the Motor Accident Injuries Act or the Workers Compensation Act. The list keeps those documents apart.
2. Section 3.35(7) requires a person who claims both statutory benefits and workers compensation to inform both insurers, unless they would already know. Signing an authority to collect records does not do that.
3. A Medicare notice of judgment or settlement is a later Commonwealth step. This list does not complete it and does not release any payment.
4. The authorities ask for health and wage records. They stay in a firm-controlled tool until the client signs them.

## Notes

- Health and wage records stay in a firm-controlled tool. The lawyer applies ASCR r 9 and APP 11, and decides whether any breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales

**Deliverable**: A list of authorities for the client to sign, separate from scheme forms.

**Inputs**

- The treatment and wage holders the lawyer has named
- Whether the lawyer has said a Medicare recovery may arise

**Example**: Illustrative example: The list has one authority for the hospital and one for the employer. It does not attach a notice to the compulsory third party insurer.

**Stop and escalate when**

- The list would be sent to Medicare as a settlement notice.
- The list would tell both insurers that both claims have been made.
