| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the treatment records the lawyer has selected, make a table of each person the record names, the role the record gives that person, the place, and the page. Do not decide who is sued. |
| What the lawyer must review | The lawyer decides who is sued. The list does not decide employment or indemnity. Do not name a compulsory recipient of a pre-court notice. No opened section does. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

The list is the starting point for the field in section 59. It does not choose the defendant.

- What the AI does: From the treatment records the lawyer has selected, make a table of each person the record names, the role the record gives that person, the place, and the page. Do not decide who is sued.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. One row per person the selected record names, with the role, place and page the record gives.
2. Section 59 asks the peer question of practitioners in the field of the professional whose service is in issue.
3. Do not add an employer, an indemnity scheme, or a defendant. None of those was in the section opened.
4. A warning allegation is section 60, not this list.

## Notes

- No indemnity scheme was opened. The list does not say who must be indemnified.
- If this is filed in the Supreme Court of Victoria, Practice Note SC Gen 25, issued on 14 May 2026, calls for particular caution with affidavit material and expert reports, and says confidential information should not go into a public AI tool.

## Practical guide

Jurisdiction: Victoria. Treatment records, before a defendant is chosen.

**Deliverable**: A table of clinicians named in the records.

**Inputs**

- Treatment records the lawyer selects
- The pages that name each person

**Example**: Illustrative example: One operation note names three people and gives a role to two of them. The table has three rows and leaves the third role blank. It names no defendant.

**Stop and escalate when**

- The tool is asked to choose the defendant.
- A person is added who is not named in the record.

Checked 2026-10-23.
