| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the treatment records the lawyer has selected, make a table of each person the record names, the role, the place and the page, and mark whether the doctor and the place are known for an initial notice. Do not decide who is sued. |
| What the lawyer must review | The lawyer decides who is sued and where an initial notice must go. Section 9A(3)(f) asks for the doctor if known. Do not invent a name the record does not give. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

The initial notice must, if known, name the doctor and must state the place. If the proposed defendant is the State, section 9A(7) says where the notice is effective.

- What the AI does: From the treatment records the lawyer has selected, make a table of each person the record names, the role, the place and the page, and mark whether the doctor and the place are known for an initial notice. Do not decide who is sued.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. One row per person the record names, with role, place and page.
2. Mark whether the doctor who provided the medical services is known, and the place, because section 9A(3)(f) and (h) require those for the initial notice.
3. If the proposed defendant is the State, record whether the place is under a Hospital and Health Service. The notice is then given to that health service chief executive, or otherwise to the chief executive officer of the department or entity.
4. Part 1 against the State is a different address. Section 9(8) requires the Crown solicitor and the department or entity. Do not use that address for the initial notice.

## Notes

- The list does not decide employment or indemnity. No indemnity scheme was opened.
- The Queensland Courts generative AI page says the user is responsible for accuracy of what is given to a court or tribunal, and that private, confidential, suppressed or legally privileged information must not go into a generative AI chatbot. Practice Direction 5 of 2025 is listed. Its text was not opened.

## Practical guide

Jurisdiction: Queensland. Treatment records before an initial notice and before a defendant is chosen.

**Deliverable**: A table of clinicians, with the section 9A name and place marked.

**Inputs**

- Treatment records the lawyer selects
- Whether the proposed defendant is the State

**Example**: Illustrative example: The note names a doctor and a public hospital. The table records both and marks section 9A(7) as the address question. It does not choose the defendant.

**Stop and escalate when**

- The tool is asked to choose the defendant.
- A doctor is named who is not in the record and is not known.
