## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | In a firm-controlled tool, make a table with one row per document brought in: date, author, a short description taken from the document, and page count. The tool adds no narrative and does not say what the document proves or which scheme it belongs to. |
| What the lawyer must review | Check each row against the paper before the index is used. Do not let the index classify a letter as TAC or WorkSafe. Keep the papers in a firm-controlled tool. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

The lawyer checks the index. The tool copies the document and does not classify the scheme.

- What the AI does: In a firm-controlled tool, make a table with one row per document brought in: date, author, a short description taken from the document, and page count. The tool adds no narrative and does not say what the document proves or which scheme it belongs to.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. One row per document. Copy the date, author and description from the document. Add no narrative.
2. Do not mark a letter as a journey claim or a during-work claim. The lawyer uses the index to look.
3. Keep personal information in a firm-controlled tool. APP 11.1 and APP 11.2 are the lawyer's check, including whether the firm is an APP entity.
4. The index is not evidence and it is not sent out.

## Notes

- The columns do not change between states. The Victorian use of the index is to let the lawyer see whether a letter is about a journey transport accident or a during-the-course-of-work transport accident, which the TAC work-related policy treats differently. The tool does not classify the letter.
- The OAIC guidelines say APP 11.1 requires an APP entity that holds personal information to take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure. APP 11.2 requires reasonable steps to destroy or de-identify personal information once it is no longer needed for a permitted purpose, unless it is in a Commonwealth record or an Australian law or a court or tribunal order requires it to be kept. The lawyer checks whether the firm is an APP entity. The Notifiable Data Breaches scheme text was not opened. The checking note still asks the lawyer to decide whether a breach would be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victoria: index of papers brought to the first injury interview

**Deliverable**: A table of the papers brought to the first interview, one row per document, checked by the lawyer.

**Inputs**

- The papers brought in
- Page counts

**Example**: Illustrative example: The client brings a TAC letter and a WorkSafe letter. The index has two rows, each with the date and the author copied from the letter. It does not say which scheme applies. The lawyer checks both rows.

**Stop and escalate when**

- The index would say what a document proves.
- The papers would be indexed in a public tool.

Checked 2026-10-23.
