| How AI is used | From the records the lawyer selects, list each organisation, whether it is unincorporated, and any name already used in correspondence. Do not decide that a name is sufficient, and do not appoint a defendant. |
| What the lawyer must review | Decide the name in which the proceeding may be commenced under s 6K. Read ss 6L and 6N before any proper-defendant appointment. Their text was not opened. Do not treat s 6K as creating the liability. It is about who can be named. Keep the file in the firm's system. ASCR r 9 and APP 11 apply. |

## Checking plan

**Verify against sources**

The lawyer chooses the name and any proper defendant. The tool only lists what the records say.

- What the AI does: From the records the lawyer selects, list each organisation, whether it is unincorporated, and any name already used in correspondence. Do not decide that a name is sufficient, and do not appoint a defendant.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Child abuse proceedings may be commenced or continued against an unincorporated organisation in its name, or in a name reasonably sufficient to identify it, as if it had legal personality.
2. A management member may exercise a function of the organisation for that Division, and the court may direct a management member to do so.
3. The table of provisions also lists s 6L, under which an unincorporated organisation may appoint a proper defendant, and s 6N, under which the court may appoint one. Those sections were not opened. Do not state their tests.

## Notes

- Do not describe the effect of appointing a proper defendant. Section 6O was seen only as a table title.
- If this is used in a Supreme Court document, read Practice Note SC Gen 23. The Court's page records amendments that came into effect on 3 February 2025. The note itself was not opened, so no clause is quoted.
- Records on this file stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales. The court in which the child abuse proceedings are brought.

**Deliverable**: A list of the names on the records, marked as incorporated or unincorporated, for the lawyer to settle the name used in the proceeding.

**Inputs**

- Records naming the organisation
- Whether it is incorporated
- Any management member named

**Example**: Illustrative example: The correspondence uses a school name and does not name a company. The tool records both the name and the absence of an incorporation record. The lawyer decides the name in which the proceeding may be commenced.

**Stop and escalate when**

- The output appoints a proper defendant.
- The output states a test from s 6L or s 6N.

Checked 2026-10-23.
