## Checking plan

**Verify against sources**

The lawyer decides which records to chase. A gap in the table is not a finding that nothing happened.

- What the AI does: Build a coverage table of the records in hand, with duplicates and apparent gaps, before a notice or a disclosure step.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. List each provider, the date range held, and the pages. Mark duplicates. Mark a period with no pages as a gap, not as an absence of treatment.
2. For a Personal Injuries Proceedings Act notice, section 9(2)(b) requires the notice to authorise the proposed defendant and, if that person is insured, that person's insurer, to have access to the records a regulation specifies. The lawyer decides whether that authority is the right next step.
3. For a damages claim under the Workers' Compensation and Rehabilitation Act, section 275(7) is the claimant's written authority to the insurer. The lawyer decides the holders it must cover.
4. Health information stays in a firm-controlled tool.

## Notes

- The Personal Injuries Proceedings Regulation was not opened for the list of records the notice must specify. The lawyer checks the current regulation before the authority is given.
- Guidance Statement No. 37 and the courts page: do not put these records into a public chatbot.

## Practical guide

Jurisdiction: Queensland plaintiff personal injury, before a notice of claim or a disclosure step.

**Deliverable**: A coverage table the lawyer uses to decide the next request.

**Inputs**

- The record set in the firm-controlled tool
- The list of providers the client has named
- The Act that will govern the notice

**Example**: Illustrative example: The table shows no general-practice notes for a six-month period. The lawyer treats that as a gap to request, and does not write that the client had no treatment in that period.

**Stop and escalate when**

- The table is about to be used as proof that treatment did not occur.
- The records are not in a firm-controlled tool.
