| How AI is used | From the lawyer's facts sheet, list the list endorsement, the documents that should be ready when the writ is served, and the rule 5.12 extension step. The tool does not write the writ. |
| What the lawyer must review | The lawyer chooses the list, writes the writ, and decides when it is served. Endorse the heading Personal Injuries List, Institutional Liability List or Dust Diseases List. Do not serve the writ until the statement of claim and the critical records can go with it. If more time is needed, apply under rule 5.12. Do not assume a 12-month Supreme Court period. |

## Checking plan

**Verify against sources**

The lawyer writes the Victorian writ. The tool lists the list endorsement and what must be ready at service.

- What the AI does: From the lawyer's facts sheet, list the list endorsement, the documents that should be ready when the writ is served, and the rule 5.12 extension step. The tool does not write the writ.
- What the lawyer does: Choose the list and write the originating process. The tool only lists the endorsement and service steps.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Endorse the heading with the Personal Injuries List, the Institutional Liability List or the Dust Diseases List, and use that name on later documents.
2. By service, be able to serve a statement of claim in the time allowed by the Supreme Court (General Civil Procedure) Rules 2025, with critical medical and economic-loss records.
3. If the preparation is not ready, seek an extension of the writ under rule 5.12 of those rules. Practice Note SC CL 3 does not state a 12-month period.
4. In the County Court, a writ or originating motion is ordinarily served within 12 months of issue. An extension is under rule 5.12 of the County Court rules.

## Notes

- Practice Note SC GEN 25, issued on 14 May 2026, covers Supreme Court documents, including pleadings, submissions and expert reports. Do not put confidential or sensitive material into a public AI tool.
- The 12-month service period was read in the County Court Common Law Division Practice Note, paragraph 15.43. It was not read as a Supreme Court period. The Supreme Court commercial list practice note was not opened.

## Practical guide

Jurisdiction: Supreme Court of Victoria Personal Injuries List, Institutional Liability List or Dust Diseases List, or the County Court Common Law Division

**Deliverable**: A filing and service checklist. The lawyer writes the writ.

**Inputs**

- The lawyer's choice of court and list
- The injury and the relief sought
- Whether the statement of claim and critical records are ready

**Example**: Illustrative example: The draft heading says only "Common Law Division". The checklist flags the missing Personal Injuries List endorsement. The lawyer rewrites the heading before filing.

**Stop and escalate when**

- The court or the list has not been chosen.
- The tool is asked to write the writ or the statement of claim.

Checked 2026-10-23.
