## Checking plan

**Verify against sources**

The lawyer writes the New South Wales statement of claim. The tool lists the practice-note readiness and directions steps.

- What the AI does: From the lawyer's facts sheet, list the readiness warning, the proposed consent orders that go with the statement of claim, and the directions date. The tool does not write the statement of claim.
- What the lawyer does: Decide the court and write the statement of claim and the proposed orders.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Under District Court Civil Practice Note 16, do not commence until the plaintiff can comply with the rules and the note. Serve proposed consent orders with the statement of claim.
2. Under Supreme Court Practice Note SC CL 1, a statement of claim commenced on or after 10 September 2026 in the General Civil List has a directions date three months from commencement, and the statement of claim should have been served by then. An existing matter, filed before that day, is not given that date. A proceeding that may go to default judgment is not given a directions date on filing.
3. SC CL 1 does not apply to professional negligence, possession, administrative law, institutional abuse, defamation or representative proceedings.

## Notes

- Supreme Court Practice Note SC GEN 23, commenced on 3 February 2025, prohibits generative AI from generating evidentiary content, and requires prior leave before it is used to draft an expert report.
- SC GEN 23 allows a chronology, an index or a witness list. No District Court generative AI practice note was opened. Practice Note 16 governs the General List.

## Practical guide

Jurisdiction: District Court General List, or the Supreme Court Common Law Division General Civil List under Practice Note SC CL 1

**Deliverable**: A filing checklist. The lawyer writes the statement of claim and the proposed orders.

**Inputs**

- The court and list
- Whether preparation is advanced enough to file
- The proposed consent orders

**Example**: Illustrative example: The statement of claim is ready but no proposed orders are with it. The checklist marks the Practice Note 16 requirement. The lawyer writes the orders before service.

**Stop and escalate when**

- The list is the professional negligence list or the institutional abuse list and SC CL 1 is being used.
- The tool is asked to write the statement of claim.

Checked 2026-10-23.
