## Checking plan

**Verify against sources**

The tool drafts structure from the approved issues. The lawyer verifies every citation and settles the submissions before they are lodged.

- What the AI does: From the approved issues table, build an internal outline of the issues and the procedural sections. Write nothing that is lodged with the Commission or a court, and do not generate the content of a person's evidence.
- What the lawyer does: Verify every citation and settle the submissions before they are filed.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. PIC13 paragraph 11(c) allows written submissions to be prepared with generative AI, subject to the later paragraphs. Paragraphs 18 and 19 require the author to verify in the body that citations, authorities and legislative references exist, are accurate and are relevant, and to make a similar verification for references to evidence. That verification must not be carried out by a generative AI tool.
2. PIC13 paragraph 20 says use of generative AI does not absolve the author's professional obligations. Paragraph 12 says generative AI must not generate the content of a person's evidence.
3. Practice Note SC Gen 23 paragraphs 16 and 17 require the same verification in submissions or a skeleton. Paragraph 17 says the verification must not be carried out solely by a generative AI tool. The note was issued on 28 January 2025 and commenced on 3 February 2025.
4. The Local Court practice note issued on 12 December 2025, commencing 12 January 2026, adopts Practice Note SC Gen 23 for all Local Court proceedings.

## Notes

- PIC13 and Practice Note SC Gen 23 allow a tool to prepare submissions where the lawyer verifies the citations and settles the document. The tool does not write a person's evidence.
- The Law Society list, current as at 14 May 2026, records District Court General Practice Note 2. Open that note before filing in the District Court. Its text was not opened.
- Health and wage records stay in a firm-controlled tool. Australian Solicitors' Conduct Rules rule 9 and Australian Privacy Principle 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales Personal Injury Commission, Supreme Court or Local Court

**Deliverable**: A structural draft the lawyer verifies and settles before lodgement.

**Inputs**

- The approved issues table
- The forum and any direction for written submissions
- The authorities the lawyer has already accepted

**Example**: Illustrative example: The draft has four headings from the issues table and one case citation. The lawyer finds no such case, deletes the citation, and adds the verification paragraph before the submissions are lodged.

**Stop and escalate when**

- A citation has not been checked by the lawyer, or the verification paragraph is missing.
- The draft contains the content of a person's evidence.

Checked 2026-10-23.
