## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the approved chronology and schedule, draft a letter or particulars that names the applicable Queensland Act, the recipient and only the heads the schedule supports. |
| What the lawyer must review | Decide whether the Personal Injuries Proceedings Act, the Motor Accident Insurance Act or chapter 5 applies Check names, dates and that the letter stays separate from the notice or claim form Do not claim a head the applicable scheme excludes |
| Written for | Queensland |
| Applies to | [Draft a letter of demand or particulars of injury from the schedule](https://ailawframework.com/practice/personal-injury-and-compensation/draft-a-letter-of-demand-or-particulars-of-injury-from-the-schedule.md) |

## Checking plan

**Verify against sources**

The lawyer chooses the Queensland Act and the demand. The letter stays separate from the notice of claim.

- What the AI does: From the approved chronology and schedule, draft a letter or particulars that names the applicable Queensland Act, the recipient and only the heads the schedule supports.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Apply section 6 first. A Motor Accident Insurance Act injury, and damages against an employer regulated by chapter 5, are outside the Personal Injuries Proceedings Act. A claim against another person for the same work injury can still be inside it. Dust-related conditions are outside it.
2. Draft only from the approved chronology and schedule. Name the recipient: the proposed respondent, the CTP insurer, or the workers' compensation insurer and employer as the case requires.
3. Keep the letter separate from a section 9 notice, a section 37 notice of accident claim, and a section 275 notice of claim for damages.
4. If a proceeding is already on foot, the lawyer settles the particulars. The tool does not invent a rule number for them.

## Notes

- Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 require the practitioner to check the accuracy of anything later filed. A letter to another party is still checked before it is sent.
- Guidance Statement No. 37 says a practitioner should take reasonable steps so an AI tool does not misuse confidential data, and should be very hesitant to allow that access where the terms do not protect confidentiality. The Queensland Courts page, not the guidance statement, says not to put private or confidential information into a public chatbot.

## Practical guide

Jurisdiction: Queensland plaintiff personal injury. The lawyer identifies the Act before the letter is sent.

**Deliverable**: A letter or particulars the other side can receive, after the lawyer settles the demand.

**Inputs**

- Approved chronology and schedule of loss
- Identity of the recipient and the Act that applies
- Client instructions on the demand

**Example**: Illustrative example: The draft asks for care that the schedule does not list. The lawyer removes that head before the letter is sent. The letter is not used as the notice of claim.

**Stop and escalate when**

- The Act is not identified.
- The draft adds a head, a date or a party the schedule does not support.
