## Checking plan

**Verify against sources**

Count 10 business days for the insurer's compliance response from receipt of the notice of claim.

- What the AI does: In the firm-controlled tool, list each section 278 and section 289 time from the dates on the file, and the date it falls due. Do not decide that a step is out of time.
- What the lawyer does: The lawyer decides which Queensland time applies and whether it has moved.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Count 10 business days for the insurer's compliance response from receipt of the notice of claim.
2. If that response is not given, record that the notice is taken to comply.
3. Count at least 10 business days to remedy, then 10 business days for the further notice.
4. Diary the compulsory conference within 3 months after the section 281 notice, unless a later date is agreed or the court has fixed or dispensed with it.

## Notes

- Section 278 requires the insurer, within 10 business days after receiving the notice, to state whether it complies, to identify any noncompliance and, if compliance is not waived, to allow at least 10 business days to remedy it. If that notice is not given in 10 business days, the notice of claim is taken to comply. A further notice is due within 10 business days after the remedy period. The employer, or employers, against whom negligence is alleged are advised within 5 business days after a complying notice or a waiver. Section 289 requires the compulsory conference within 3 months after the insurer gives the claimant a written notice under section 281, unless the parties agree a later date or the court fixes the time or dispenses with the conference. The text of section 281 was not opened. This diary is not the limitation count in section 302.
- Keep health and wage records in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland: the insurer's compliance response under section 278 and the compulsory conference under section 289

**Deliverable**: A diary of the Queensland compliance and conference dates, each tied to the notice that starts it.

**Inputs**

- Date the notice of claim was received
- Any compliance response
- Section 281 notice, if given

**Example**: Illustrative example: The insurer has not responded 12 business days after receipt. The tool marks the notice as taken to comply under section 278(4). The lawyer checks that no response was in fact received.

**Stop and escalate when**

- The receipt date cannot be proved.
- The conference is diarised without a section 281 notice, an agreement or an order.

Checked 2026-10-23.
