## Key facts

| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the receipt date the lawyer confirms, list each day-count in sections 37A, 39 and 41 and the calendar date it produces. Flag a step the section does not state as a day count. |
| What the lawyer must review | You decide which receipt date starts each clock. The offer under section 41(2) is as soon as practicable. Do not turn that into a day count. A diary date is a prompt. It is not advice that the claim is in time. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The lawyer confirms the receipt date. The tool counts only the periods the sections state.

- What the AI does: From the receipt date the lawyer confirms, list each day-count in sections 37A, 39 and 41 and the calendar date it produces. Flag a step the section does not state as a day count.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Use the receipt date the lawyer confirms.
2. Count 14 days, the further 14 days, 1 month, 6 months and 3 months only where the section states them.
3. Leave the section 41(2) offer undated.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- Section 39(1)(a): 14 days for the compliance and rehabilitation response. Section 39(1)(b): a further notice within 14 days after the remedy period if the first response did not waive compliance, even where the further notice then waives it. Section 37A: the additional information form is due within 1 month of the request. Section 41(1): the liability notice is due within 6 months of receipt, and section 41(3) moves that receipt if the notice did not comply. A response to a written offer is due within 3 months after it is received, unless the response is the one under section 41(1)(c).

## Practical guide

Jurisdiction: Diary dates after a Queensland motor-accident notice

**Deliverable**: A diary of the stated periods from the confirmed receipt date.

**Inputs**

- The date the lawyer confirms the insurer received the notice
- Whether an additional information form was requested
- Whether the notice complied

**Example**: Illustrative example: The lawyer confirms receipt on 1 April 2026 and the notice complied. The diary shows 15 April 2026 for the 14-day response and 1 October 2026 for the liability notice. It leaves the settlement offer undated.

**Stop and escalate when**

- The receipt date is not confirmed.
- Compliance is in dispute and section 41(3) has not been applied by the lawyer.

Checked 2026-10-23.
