| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Copy the date of the notice, the decision in the notice's own words, and any response date the notice prints. Do not calculate a section 39 or section 41 date the notice does not state. |
| What the lawyer must review | Check that each date is copied from the notice and is not calculated. A statutory period is not written in unless the notice states that date. Do not treat a copied date as advice that time is still running. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |

## Checking plan

**Verify against sources**

The tool copies dates the notice prints. It does not calculate the statutory response periods.

- What the AI does: Copy the date of the notice, the decision in the notice's own words, and any response date the notice prints. Do not calculate a section 39 or section 41 date the notice does not state.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Copy the notice date and any date the notice prints.
2. Leave blank a 14-day, six-month or three-month date the notice does not state.
3. Do not describe a blank as a missed deadline.

## Notes

- Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- Section 39(1)(a) requires a written response within 14 days on compliance and on rehabilitation funding. If that response does not waive compliance, section 39(1)(b) requires a further written notice within 14 days after the period allowed to remedy it, and that further notice may itself waive compliance. Silence for 14 days conclusively presumes the insurer is satisfied the notice was given as required. It does not stop a later denial that the recipient is not the insurer.
- Section 41(1) requires the liability notice within 6 months after the insurer receives the notice. If the notice did not comply, section 41(3) treats it as received when the insurer gives notice that it waives the defect or is satisfied the claimant has taken reasonable action to remedy it, or when the court declares the claimant taken to have remedied it or gives leave to proceed despite it. A written response to an offer is due within 3 months after it is received, unless the response is the one under section 41(1)(c). The offer under section 41(2) is due as soon as practicable, which is not a day count.

## Practical guide

Jurisdiction: Dates on a Queensland compulsory third-party notice

**Deliverable**: A copy of the dates and words the notice prints, with statutory periods left blank.

**Inputs**

- The insurer's notice
- The envelope or email date, if the notice states it

**Example**: Illustrative example: The notice is dated 2 March 2026 and states no response date. The table records 2 March 2026. It does not add 14 days or 6 months.

**Stop and escalate when**

- The notice is not on the file.
- A calculated deadline is needed and the notice does not state it.
