## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the draft consent order, record whether mediation is addressed and, if it is not, whether an explanation is with the order. The tool does not write a position paper or decide who must attend. |
| What the lawyer must review | The lawyer decides whether mediation is appropriate and writes the order. If the order does not address mediation, give the explanation paragraph 20 requires. Treat rule 428 as a conference of experts, not as the mediation. Do not state who must attend a mediation. The opened direction does not say. |

## Checking plan

**Verify against sources**

The lawyer settles the order. The tool checks that mediation is addressed or explained.

- What the AI does: From the draft consent order, record whether mediation is addressed and, if it is not, whether an explanation is with the order. The tool does not write a position paper or decide who must attend.
- What the lawyer does: Decide whether to mediate and what the order says. The tool checks paragraph 18.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Practice Direction 9 of 2023 says a consent order should, as appropriate, address mediation.
2. It should also address expert evidence under chapter 11 part 5, including a joint expert or a conclave report, where that is appropriate.
3. If mediation is not addressed, the parties provide an explanation with the order.
4. Do not take an attendance rule from another court. This direction does not prescribe who attends.

## Notes

- Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 require a named practitioner to verify references in submissions. They are not a ban on generative AI in evidence.
- The Queensland Courts generative AI page says not to enter private, confidential, suppressed or privileged information into a public chatbot.

## Practical guide

Jurisdiction: Supreme Court of Queensland, Brisbane, under amended Practice Direction 9 of 2023

**Deliverable**: A note of whether the consent order addresses mediation, and any explanation.

**Inputs**

- The draft consent order
- Whether the parties have agreed to mediate
- Any expert-conference direction

**Example**: Illustrative example: The order directs a conclave and says nothing about mediation. The checklist separates rule 428 from mediation and asks for the explanation. The lawyer adds it.

**Stop and escalate when**

- The proceeding is outside Practice Direction 9.
- The tool is asked to decide that a person must attend.

Checked 2026-10-23.
