| What the lawyer must review | The lawyer decides if the words are an apology, an expression of regret, or an unprotected admission. Keep the words as spoken or written. Do not smooth them. ## Checking plan

**Source-by-source verification**

Trace relied-on content to independent sources and check for relevant material the output has missed.

- What the AI does: Extract the words of regret or apology as they appear in the email, letter or note, and name the speaker and the date. Do not say whether the words are admissible.
- What the lawyer does: The lawyer decides if the words are an apology, an expression of regret, or an unprotected admission. Keep the words as spoken or written. Do not smooth them. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth).
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Extract the words. Do not tidy an acknowledgment of fault into an apology.
2. In Victoria apply section 14I and keep section 14J(3) in view.
3. In Queensland label the words as an expression of regret or as an apology before applying a section.
4. In New South Wales state the section 69 effect and do not invent the section 68 definition.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
