| How AI is used | From the defendant and the cause the lawyer has named, record whether a proceeding has been issued and whether any summons is proposed. Do not decide that no other Act could require a notice. |
| What the lawyer must review | Decide whether this proceeding should be in the Institutional Liability List. Check the named cause for a pre-court notice before this list is treated as the only step. A summons may be returnable on a sitting Friday more than seven days ahead. Keep the file in the firm's system. ASCR r 9 and APP 11 apply. |

## Checking plan

**Verify against sources**

The lawyer decides the forum and any notice. The tool records what has already been filed.

- What the AI does: From the defendant and the cause the lawyer has named, record whether a proceeding has been issued and whether any summons is proposed. Do not decide that no other Act could require a notice.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The table of provisions of the Wrongs Act 1958 that was opened contains the organisational-duty and non-economic-loss Parts. It does not contain a compulsory pre-court notice of claim.
2. Proceedings which the Supreme Court says should be in the Institutional Liability List are managed under Practice Note SC CL 3. Paragraph 7.1 says interlocutory applications are generally heard on Fridays during sitting terms by a judicial registrar, an associate judge, or a judge. It does not put every directions hearing before a judicial registrar alone.
3. A party does not need a return date from the registry. A summons may be made returnable on any sitting Friday more than seven days ahead. The list email is institutional.liability@supcourt.vic.gov.au.
4. This does not say there is no notice step in some other Act. The lawyer still checks the cause. The County Court list page was not usable and is not described.

## Notes

- The list page names the judges in charge. Confirm the page before relying on who is in charge.
- If this is used in a Supreme Court document, the Court's news page on Practice Note SC Gen 25 says court users are responsible for the content whether or not they used AI.

## Practical guide

Jurisdiction: Supreme Court of Victoria, Institutional Liability List, under Practice Note SC CL 3.

**Deliverable**: A note of whether the lawyer has selected that list, and of any summons already proposed.

**Inputs**

- The cause the lawyer has named
- Whether a proceeding has been issued
- Any proposed summons and its return date

**Example**: Illustrative example: A summons is to be filed on a Monday for the Friday of the same week. The tool records that the Friday is not more than seven days ahead. The lawyer chooses a later sitting Friday.

**Stop and escalate when**

- The cause may be a work or transport claim with its own notice.
- The County Court list is being described from the failed page.
