## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the defendant and the cause the lawyer has named, record whether the lawyer has classed the claim as a work injury, a transport accident, or another personal injury, and list any notice already sent. Do not decide that a pre-court Act applies, and do not draft a notice. |
| What the lawyer must review | Decide which pre-court Act, if any, applies. Do not assume an abuse claim is exempt from all of them. In Queensland, read section 6 before you skip a notice. Only two sections are disapplied for an intentional act. Check that a notice to an unincorporated institution goes to the head of the institution. Keep the file in the firm's system. Confidentiality, APP 11 and a notifiable-breach check apply. |

## Checking plan

**Source-by-source verification**

Trace relied-on content to the linked sections and check for a definition or exception the output has missed.

- What the AI does: From the defendant and the cause the lawyer has named, record whether the lawyer has classed the claim as a work injury, a transport accident, or another personal injury, and list any notice already sent. Do not decide that a pre-court Act applies, and do not draft a notice.
- What the lawyer does: Decide which pre-court Act, if any, applies. Do not assume an abuse claim is exempt from all of them. In Queensland, read section 6 before you skip a notice. Only two sections are disapplied for an intentional act. A notice to an unincorporated institution goes to the head of the institution. Keep the file in the firm's system. Confidentiality, APP 11 and a notifiable-breach check apply.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.

## Checks the lawyer makes

1. Class the defendant first. A workers' compensation or motor-accident exclusion can take the claim out of the Queensland pre-court Act, or into a different notice.
2. Do not treat Queensland s 6(4) as an exemption from the notice of claim. It disapplies ss 40(2) and 56 only.
3. Where the Queensland defendant is unincorporated, address the notice to the head of the institution.
4. Do not invent a number of months. The notice time was not opened.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Before any output is used in a court document, read the forum's generative AI rule: Victoria, Supreme Court Practice Note SC Gen 25; New South Wales, Practice Note SC Gen 23; Queensland, the courts' generative AI page and Supreme Court Practice Direction 5 of 2025.
