## Checking plan

**Verify against sources**

The lawyer decides service. The tool lists the rule 429H items against the report.

- What the AI does: From the report the lawyer selects, list each rule 429H item and quote the confirmation in subrule (4), with the page. The tool does not rewrite the report.
- What the lawyer does: Decide whether the report meets rule 429H and Schedule 1C.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The report is addressed to the court and signed, and includes the qualifications, facts, reasons, literature, inspections, range of opinion, qualifications on the opinion, a summary of the conclusions, and whether readily ascertainable additional facts would assist.
2. Subrule (4) requires confirmation of each of (a) to (f): the expert has read and agrees to be bound by the code; the factual matters are true so far as the expert knows; all inquiries considered appropriate have been made; the opinions are genuinely held; the report refers to all matters the expert considers significant; and the expert understands the duty to the court and has complied with it.
3. Schedule 1C is the code. It applies to an expert appointed to give opinion evidence.
4. Rule 428 lets the court direct a conference and a joint report. It does not replace the confirmation.

## Notes

- Supreme Court Practice Direction 5 of 2025 and District Court Practice Direction 12 of 2025 require a named practitioner to verify references in submissions. They are not a ban on generative AI in evidence.
- Rule 429F is named in Schedule 1C. The text of rule 429F was not opened. The confirmation used here is rule 429H(4).

## Practical guide

Jurisdiction: A Queensland proceeding in which an expert report is served under chapter 11

**Deliverable**: A rule 429H checklist marked to the report.

**Inputs**

- The signed report
- The questions the expert was asked
- Whether a conference has been directed

**Example**: Illustrative example: The report states the opinions but has no subrule (4) confirmation. The checklist marks that item. The lawyer decides whether to go back to the expert.

**Stop and escalate when**

- The report is unsigned.
- The tool is asked to draft the confirmation for the expert.
