## Checking plan

**Verify against sources**

The lawyer decides whether anything can still be challenged. The note records what the opened pages allow. It does not draft the dispute.

- What the AI does: From the assessment notice and the reports it cites, list each percentage, the date of the opinion, and whether the opened pages allow the matter to be reopened. Do not draft a dispute.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Medical Panels says that once it has issued its opinion it cannot reopen the matter. For most WorkCover cases the opinion takes about four weeks from the appointment. The page was updated on 28 August 2026. For a Wrongs Act case the panel usually provides the opinion within 30 days of the last appointment.
2. The Workplace Injury Commission says a conciliation officer may refer a medical question to a Medical Panel for an opinion that is binding and must be accepted by those involved. A disagreement with that opinion is for the lawyer.
3. The opened pages do not state a number of days in which to dispute an independent impairment assessor's percentage. Do not insert one. If the document is an agent's or self-insurer's decision, conciliation is a separate step and the application should be sent within 60 days of receiving that decision.
4. The worker does not, on these pages, lodge the Medical Panel referral. A conciliation officer may refer the medical question.

## Notes

- If a challenge is later filed in the County Court, the lawyer writes it and verifies it under the practice note of 9 June 2026. No Workplace Injury Commission generative-AI practice note was found.
- Asking another tool to confirm the percentages is not verification. Check them against the notice.

## Practical guide

Jurisdiction: Victoria: an impairment assessment or a Medical Panel opinion on a WorkSafe claim

**Deliverable**: A note of the percentages and whether the opened pages allow reopening.

**Inputs**

- The opinion or notice and the date it was received
- The percentages and the reports they cite
- Whether a conciliation is already on foot

**Example**: Illustrative example: A Medical Panel opinion has issued and the worker disagrees with the percentage. The note records that the panel cannot reopen the matter. It does not draft a further referral. The lawyer decides whether there is a legal question.

**Stop and escalate when**

- The note states a last day to dispute that is not on an opened page.
- The note says the panel will hear the matter again.
