## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the final expert report, table the stated facts, reasons, qualifications, literature, inspections and the code confirmation. List any schedule 1C item that is missing, and copy any sentence in which the report itself mentions a generative tool. Do not rewrite the opinion. |
| What the lawyer must review | The expert's duty is to assist the court, and the expert is not an advocate. Ask the expert to fix a missing code item. The opinion stays the expert's. The code opened has no generative-tool clause. Do not invent one. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach. |
| Written for | Queensland |

## Checking plan

**Verify against sources**

The lawyer checks the report against schedule 1C. The tool extracts what the report already says.

- What the AI does: From the final expert report, table the stated facts, reasons, qualifications, literature, inspections and the code confirmation. List any schedule 1C item that is missing, and copy any sentence in which the report itself mentions a generative tool. Do not rewrite the opinion.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Confirm the report is addressed to the court and signed.
2. Check that the facts the opinion uses are stated, and compare them with the records.
3. Check the code confirmation in schedule 1C clause 8(4), including the duty to the court.
4. Record any generative-tool sentence that is actually in the report, and nothing more.

## Notes

- Health, wage and benefit records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
- Schedule 1C applies to an expert appointed to give opinion evidence in a proceeding. Rule 429F, as cited in the code, requires compliance. Queensland Courts directs criminal expert evidence to Supreme Court Practice Direction 14 of 2024, paragraph 16(l). That direction was not the civil code.
- If the product is used in a Supreme Court submission, Practice Direction 5 of 2025 requires the named practitioner to verify every reference. District Court Practice Direction 12 of 2025 is the matching direction opened for that court.

## Practical guide

Jurisdiction: Supreme Court or District Court of Queensland, civil personal injury proceeding

**Deliverable**: A schedule 1C review table and a list of assumptions the records do not support.

**Inputs**

- Final expert report
- Letter of instruction
- Records the expert was given
- Any court direction on expert evidence

**Example**: Illustrative example: The report gives a diagnosis but does not list the imaging it used. The table marks schedule 1C clause 8(2)(b) as missing. It does not supply the missing facts.

**Stop and escalate when**

- The report is a draft the expert has not signed.
- Filling a gap would mean writing the expert's opinion.
