## Checking plan

**Verify against sources**

The lawyer checks compliance and asks the expert to resolve missing information; the expert retains responsibility for the opinion.

- What the AI does: Extract stated assumptions, qualifications, sources and disclosure sections from the final permitted expert report into a review table.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects the consequence of an error and the amount of independent review the described output needs.
- Restriction: This review does not generate the expert’s opinion or establish that the report is admissible.
- Written for: NSW

## Checks the lawyer makes

1. Read the whole report and verify the table against every relevant passage, preserving provisional views and qualifications.
2. Check the expert’s qualifications, factual assumptions, materials, reasons and any issue outside their expertise.
3. For PIC work, check the PIC4 and PIC13 acknowledgements and AI-use or non-use statement; where AI was used, check the required parts, tool/version/date and annexed use record.
4. Refer omissions or contradictions back to the expert; do not use AI to rewrite or strengthen their opinion.

## Notes

- These are suggested working checks. The cited court, tribunal or scheme requirements apply only within their stated scope.

## Practical guide

Jurisdiction: NSW Personal Injury Commission; court proceedings may impose different requirements

**Deliverable**: An expert-report review table and targeted follow-up questions.

**Inputs**

- Final expert report and annexures
- Letter of instruction
- Material provided to the expert
- Current PIC4 and PIC13

**Example**: Illustrative example: The report identifies an AI tool but gives no version or use record. The review asks the expert for the missing disclosure instead of completing it on their behalf.

**Stop and escalate when**

- An AI-generated summary has lost a qualification or changed the expert’s reasoning.
- The report is intended for another court and its separate leave or disclosure rules have not been checked.
