| How AI is used | List the incident date and the discoverability facts the lawyer has already marked. Do not prepare a pre-court notice and do not calculate the last day. |
| What the lawyer must review | The lawyer diarises the limitation facts. The tool does not calculate the last day. Do not use a Queensland notice. Section 50C does not require one. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

Section 50C is the first to expire of the 3-year post-discoverability period and the 12-year long-stop. It does not give extra time for a notice.

- What the AI does: List the incident date and the discoverability facts the lawyer has already marked. Do not prepare a pre-court notice and do not calculate the last day.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Record the act or omission and the discoverability date the lawyer has marked.
2. State the 3-year period as running from and including the date the cause of action is discoverable, and the 12-year period as running from the time of the act or omission.
3. Use section 50D: injury or death occurred, it was caused by the fault of the defendant, and, for injury, it was sufficiently serious to justify an action. A person ought to know a fact if all reasonable steps would have ascertained it.
4. Leave survivor actions to section 50C(2). They are not this task. The note to section 50C says the long-stop can be extended under Division 4. That Division was not opened.

## Notes

- The sections opened do not impose a pre-court notice for an ordinary public liability injury. Do not prepare one.
- If this is filed in the Supreme Court of New South Wales, Practice Note SC Gen 23, issued on 28 January 2025 and commenced on 3 February 2025, bars generative AI from the content of an affidavit or witness statement, and from an expert report without prior leave, subject to paragraph 23.

## Practical guide

Jurisdiction: New South Wales. An ordinary public liability injury, with section 50C to be diarised.

**Deliverable**: A date list from facts the lawyer has marked. No notice is prepared.

**Inputs**

- Incident date the lawyer marks
- Discoverability facts the lawyer marks

**Example**: Illustrative example: The lawyer has marked the injury date and not the date it was known to be serious. The list leaves that fact blank and does not name a last day.

**Stop and escalate when**

- The tool is asked to prepare a notice or name the last day.
- The claim is a survivor action under section 50C(2).

Checked 2026-10-23.
