| How AI is used | From the proposed index, flag a medical record, a tax document, a superseded pleading, a service document and a duplicate. The tool does not decide what is tendered. |
| What the lawyer must review | The lawyer decides what is given to the trial judge. Do not treat a document left out of the file as unable to be tendered. Do not include medical records or tax documents as a matter of course. Treat a County Court eCourtBook as a separate set of requirements. |

## Checking plan

**Verify against sources**

The lawyer settles the file. The tool checks it against Practice Note SC CL 3 and the eCourtBook rules.

- What the AI does: From the proposed index, flag a medical record, a tax document, a superseded pleading, a service document and a duplicate. The tool does not decide what is tendered.
- What the lawyer does: Settle the key documents file. The tool flags documents the practice note excludes.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The file should help the judge before the trial. It should not resemble a traditional court book.
2. As a guide it may include the current pleadings, the joint memorandum, relevant submissions, significant orders and critical documents a party anticipates tendering.
3. It should not, as a matter of course, include overarching obligations certificates, prior versions of pleadings, affidavits of service, medical records or tax documents.
4. The electronic file is one fully text-searchable PDF, bookmarked, with page numbers that match the viewer. Documents to be shown to a witness go in a separate bundle.
5. A County Court eCourtBook is, wherever possible, an agreed joint text-searchable PDF, filed by 12 noon on the weekday before trial. A book over 20 MB is sent by a file-sharing link.

## Notes

- Practice Note SC GEN 25, issued on 14 May 2026, covers Supreme Court documents, including pleadings, submissions and expert reports. Do not put confidential or sensitive material into a public AI tool.
- Interrogatories and answers included in the key documents file must comply with rule 30.06(3) of the Supreme Court (General Civil Procedure) Rules 2025.

## Practical guide

Jurisdiction: Supreme Court of Victoria personal injury lists, or a County Court eCourtBook under the Common Law Division practice note

**Deliverable**: A marked index of the proposed file.

**Inputs**

- The proposed index
- The court
- The final directions orders

**Example**: Illustrative example: The index includes the tax returns and an old statement of claim. The checklist flags both. The lawyer removes them unless the judge has asked for them.

**Stop and escalate when**

- The index cannot be opened against the documents.
- The tool is asked to tender a document.

Checked 2026-10-23.
