## Checking plan

**Verify against sources**

The lawyer settles the court book. The tool checks the Practice Note 16 limits and the three-clear-day documents.

- What the AI does: From the proposed court book, flag a document that is not specifically relevant and any duplicate, and list the schedules that are due three clear days before the hearing. The tool does not decide the tender.
- What the lawyer does: Settle the book and the schedules. The tool flags irrelevance and duplication.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. A court book for tender is limited to documents specifically relevant to that party's case. Duplication is avoided as far as possible.
2. The plaintiff's chronology is served at least three clear days before the hearing. The plaintiff reads it before giving evidence, and it is tendered.
3. Each party serves a schedule of medical and expert reports at least three clear days before the hearing, and files and serves a schedule of objections to expert evidence in that same time.
4. Schedules of damages and of issues are served in the same time. A joint expert report, where concurrent evidence is used, is filed no later than two clear days before the hearing.

## Notes

- Supreme Court Practice Note SC GEN 23, commenced on 3 February 2025, prohibits generative AI from generating evidentiary content, and requires prior leave before it is used to draft an expert report.
- SC GEN 23 allows a chronology, an index or a witness list. No District Court generative AI practice note was opened. Practice Note 16 governs the General List.

## Practical guide

Jurisdiction: District Court of New South Wales General List, standard orders for hearings in Practice Note 16

**Deliverable**: A marked court-book index and a list of the schedules and their dates.

**Inputs**

- The proposed court book
- The hearing date
- The expert reports to be tendered

**Example**: Illustrative example: The book contains two copies of the same report and a bundle of unread clinical notes. The checklist flags both. The lawyer keeps only the documents to be tendered.

**Stop and escalate when**

- The hearing date is unknown, so the three clear days cannot be counted.
- The tool is asked to tender a document.
