## Checking plan

**Verify against sources**

Section 53 defines an obvious risk for section 54. The sections opened do not remove liability for a dangerous recreational activity.

- What the AI does: List the activity, the risk the other side names, and whether the client knew of it, each tied to a document. Do not decide whether a defence succeeds.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. List the activity, the risk named, and any document about whether the client knew of it.
2. Apply section 53 only as a definition for section 54: a risk that would have been obvious to a reasonable person in the position of the person who suffers harm.
3. Note section 53(5): a risk from a thing, including a living thing, is not an obvious risk if created by a failure to properly operate, maintain, replace, prepare or care for the thing, unless that failure itself is obvious.
4. Do not advise that there is no liability because the activity was recreational. No such defence was in the sections opened.

## Notes

- The page after section 53 shows that section 54 follows. The text of section 54 and of section 55 was not opened. The lawyer reads both before using either.
- If this is filed in the Supreme Court of Victoria, Practice Note SC Gen 25, issued on 14 May 2026, calls for particular caution with affidavit material and expert reports, and says confidential information should not go into a public AI tool.

## Practical guide

Jurisdiction: Victoria. A recreation claim in which an obvious-risk or dangerous-activity point is raised.

**Deliverable**: A comparison of the activity and the risk with section 53. The lawyer writes the conclusion.

**Inputs**

- The activity described in the documents
- The risk the other side names
- Any document on whether the client knew of the risk

**Example**: Illustrative example: The other side calls a trail ride a dangerous recreational activity. The list records the activity and the risk from the letter. It does not apply a no-liability defence the opened sections do not contain.

**Stop and escalate when**

- The tool is asked to decide that a defence succeeds.
- Section 54 or section 55 is to be applied before the lawyer has read it.
