## Checking plan

**Verify against sources**

The tool calculates interest only on the past monetary loss the lawyer accepts, and only at a rate the lawyer confirms is within section 60.

- What the AI does: Calculate interest only on the past monetary loss the lawyer accepts, and leave out general damages and section 59 gratuitous services. Do not insert the bond rate.
- What the lawyer does: The lawyer decides the rate, the period, and which heads are claimed as past monetary loss.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 60(1): a court cannot order interest on an award for general damages, or on an award of damages for gratuitous services provided to an injured person. That second bar is in section 60(1)(b). The services it describes are gratuitous services provided to an injured person, which is the section 59 subject. Section 60 does not name section 59A. Do not extend the bar to section 59A.
2. Interest on damages compensating past monetary loss must not be more than the appropriate rate and must relate to the period the loss was incurred.
3. The appropriate rate is the rate for 10-year Treasury bonds published by the Reserve Bank under Capital Market Yields, Government Bonds, Daily, F2, as at the beginning of the quarter in which the award of interest is made. The current rate was not opened. Do not insert a number.
4. The example formula in the section is an example for expenses incurred at a uniform rate. The letter a is a percentage the court decides, subject to the section 60(2) limit. The cap is the bond rate. Do not treat the example's 0.5 as the rate.

## Notes

- Apply this only if the lawyer says chapter 3 applies. Section 5 may take the injury outside the Act.
- Wage, tax and care records stay in a firm-controlled tool. Apply ASCR r 9 and APP 11, and consider whether a breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland interest on an award of personal injury damages to which chapter 3 applies

**Deliverable**: An interest working on past monetary loss only, with the rate blank until the lawyer confirms it is within the bond rate.

**Inputs**

- The past monetary loss the lawyer accepts and the period it was incurred
- The rate the lawyer confirms

**Example**: Illustrative example: The working calculates interest on past out-of-pocket expenses at the rate the lawyer typed. It leaves general damages out, and it does not halve the bond rate.

**Stop and escalate when**

- The draft inserts a bond rate.
- The draft adds interest on general damages or on section 59 services.
