## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the incident report, photographs and inspection or cleaning records the lawyer marks, list each hazard, inspection and earlier complaint with the date and the document. Do not write a medical chronology or the client's account. |
| What the lawyer must review | Use a date only when the named document shows it. The lawyer decides which records show the hazard, any inspection and any earlier complaint. Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

The chronology is built to answer section 14B and the section 48 precautions test, including section 48(3).

- What the AI does: From the incident report, photographs and inspection or cleaning records the lawyer marks, list each hazard, inspection and earlier complaint with the date and the document. Do not write a medical chronology or the client's account.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Tie each hazard, inspection and earlier complaint to a document and a date the document shows.
2. Where the claim is about the state of the premises, note the section 14B(4) factors the chronology can and cannot answer.
3. For a precautions case, record foreseeability, whether the risk was not insignificant, and the four section 48(2) considerations.
4. Apply section 48(3) as opened: insignificant risks include far-fetched or fanciful risks, and risks that are not insignificant include significant risks.

## Notes

- Section 53 defines an obvious risk for section 54. Section 53(5) says a risk from a thing, including a living thing, is not an obvious risk if the risk is created by a failure to properly operate, maintain, replace, prepare or care for the thing, unless that failure itself is an obvious risk. Whether the risk was obvious is a separate task. Do not decide it here.
- If this is filed in the Supreme Court of Victoria, Practice Note SC Gen 25, issued on 14 May 2026, calls for particular caution with affidavit material and expert reports, and says confidential information should not go into a public AI tool.

## Practical guide

Jurisdiction: Victoria. A premises-fall chronology for section 14B or section 48.

**Deliverable**: A dated hazard and inspection chronology, for the lawyer to settle.

**Inputs**

- Incident report and photographs
- Inspection or cleaning records the lawyer marks
- Any earlier complaint the lawyer marks

**Example**: Illustrative example: A cleaning log has a date and a later incident report describes a spill. The chronology records both dates from those pages. It does not add a date that no document shows.

**Stop and escalate when**

- A date cannot be read from the named document.
- The material is a medical chronology, not a hazard record.
