| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the incident report, photographs and inspection or cleaning records the lawyer marks, list each hazard, inspection and earlier complaint with the date and the document. Do not write a medical chronology or the client's account. |
| What the lawyer must review | Use a date only when the named document shows it. Keep the foreseeability words as "ought reasonably to have known". Keep health and wage records in a firm-controlled tool, not a public one. ASCR r 9 and APP 11 apply. Decide if a breach is notifiable under the Privacy Act 1988 (Cth). |

## Checking plan

**Verify against sources**

The chronology answers section 9. The opened section has no occupier factor list and no section 48(3) definition.

- What the AI does: From the incident report, photographs and inspection or cleaning records the lawyer marks, list each hazard, inspection and earlier complaint with the date and the document. Do not write a medical chronology or the client's account.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Tie each hazard, inspection and earlier complaint to a document and a date.
2. Ask whether the risk was one the person knew or ought reasonably to have known, and whether it was not insignificant.
3. Record probability, likely seriousness, burden and social utility from section 9(2) where the documents speak to them.
4. Do not insert a definition of "insignificant" that section 9 does not contain.

## Notes

- Section 9 does not contain the Victorian definition that insignificant risks include far-fetched or fanciful risks. Do not add it.
- The Queensland Courts generative AI page says the user is responsible for accuracy of what is given to a court or tribunal, and that confidential information must not go into a public chatbot. Practice Direction 5 of 2025 is listed. Its text was not opened.

## Practical guide

Jurisdiction: Queensland. A premises-fall chronology for section 9.

**Deliverable**: A dated hazard and inspection chronology against section 9.

**Inputs**

- Incident report and photographs
- Inspection or cleaning records the lawyer marks

**Example**: Illustrative example: An inspection sheet is undated and a complaint email has a date. The chronology records the email date and leaves the inspection date blank.

**Stop and escalate when**

- The only dates are medical, not hazard dates.
- A document the chronology cites cannot be found.

Checked 2026-10-23.
