## Checking plan

**Verify against sources**

The lawyer writes the orders. The tool builds the New South Wales listing agenda.

- What the AI does: From the commencement date and the orders, list the directions date, the five-working-day email, the pre-trial conference and the status conference. The tool does not write the orders.
- What the lawyer does: Settle the proposed orders. The tool lists the practice-note dates.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Practice Note SC CL 1 gives a General Civil List statement of claim commenced on or after 10 September 2026 a directions date three months from commencement. By then the statement of claim should have been served and any defence filed. An existing matter, filed before that day, is not given that date. A proceeding that may go to default judgment is not given a directions date on filing.
2. Five working days before, email proposed orders in Word to the Common Law Registrar, with a note of no more than one page. Send orders that are not agreed as well.
3. At the first judicial case-management review, each party must be ready to take a hearing date. Directions may cover evidence, a single expert, interrogatories, a view and alternative dispute resolution.
4. District Court Practice Note 16 holds the pre-trial conference two months after commencement. At the status conference the case takes a hearing date. Paragraph 38 requires that hearing date to fall between 8 and 11 months from commencement, except where the case cannot for good reason be heard within 12 months.

## Notes

- Supreme Court Practice Note SC GEN 23, commenced on 3 February 2025, prohibits generative AI from generating evidentiary content, and requires prior leave before it is used to draft an expert report.
- SC GEN 23 allows a chronology, an index or a witness list. No District Court generative AI practice note was opened. Practice Note 16 governs the General List.

## Practical guide

Jurisdiction: Supreme Court General Civil List under Practice Note SC CL 1, or the District Court General List under Practice Note 16

**Deliverable**: A listing agenda. The lawyer writes the proposed orders.

**Inputs**

- The commencement date
- The court
- The current proposed orders

**Example**: Illustrative example: The directions date is in four working days and no Word orders have been emailed. The agenda marks that deadline. The lawyer writes the orders.

**Stop and escalate when**

- The proceeding is on a list excluded by Practice Note SC CL 1.
- The tool is asked to sign the orders.
