## Checking plan

**Verify against sources**

The tool builds a chronology. The lawyer checks it against the records before it is used.

- What the AI does: From records held in a firm-controlled tool, build a dated chronology of treatment, complaints and investigations, with the source of each row. Do not diagnose and do not rewrite a person's evidence.
- What the lawyer does: Check the chronology against the records and decide what may be used.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. PIC13 paragraph 11(a) allows a chronology. Paragraph 12 says generative AI must not generate the content of a person's evidence.
2. PIC13 paragraph 10 and Practice Note SC Gen 23 paragraph 9A restrict putting subpoenaed or compulsorily produced material into a generative AI program.
3. Practice Note SC Gen 23 paragraph 9B(a) allows a chronology. Paragraph 10 prohibits generating the content of an affidavit or the witness's evidence.
4. The Local Court practice note commencing 12 January 2026 adopts Practice Note SC Gen 23 for all Local Court proceedings.

## Notes

- The Law Society's court-protocol list, current as at 14 May 2026, records a separate District Court generative AI practice note. Open that note before a District Court chronology is prepared for filing.
- Health records stay in a firm-controlled tool. Australian Solicitors' Conduct Rules rule 9 and Australian Privacy Principle 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales Personal Injury Commission, Supreme Court or Local Court

**Deliverable**: A source-tagged chronology for the lawyer to check.

**Inputs**

- Medical records held in the firm's system
- The forum, if proceedings are on foot
- Any direction limiting use of produced documents

**Example**: Illustrative example: The draft chronology lists three attendance dates. Two match the notes. One does not appear on the cited page. The lawyer removes that row before the chronology is used.

**Stop and escalate when**

- The records were produced under subpoena or a direction and the tool is not a controlled system meeting paragraph 10 or 9A.
- The output starts to retell what a person says happened, rather than listing the record.
