| What the lawyer must review | Set the dependency and the period. Do not award a figure. Ignore only a sum section 19(1) lists. After the 2004 Act, make no separate reduction for remarriage or a domestic partnership, or its prospects. |

## Checking plan

**Victorian disregard list**

The tool rows support and marks the section 19 sums. The lawyer sets the dependency and makes no remarriage reduction of the kind section 19(2) forbids.

- What the AI does: In a firm-controlled tool, row each dependant's support and mark a receipt that section 19(1) of the Wrongs Act 1958 says is not taken into account. Do not insert a remarriage discount.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Tie earnings to a wage record and services to a document.
2. Mark insurance, superannuation, the listed pensions and benefits, and a gratuity.
3. Apply section 19(2) only to an action commenced on or after the Wrongs (Remarriage Discount) Act 2004.
4. Use the section 19 definitions of domestic partner and spouse.

## Notes

- Section 19(1) of the Wrongs Act 1958 says that, in a Part III action, there shall not be taken into account a sum paid or payable on the death under a contract of assurance or insurance, including a contract with a friendly or other benefit society, association or trade union, a sum paid or payable out of a superannuation, provident or like fund, a sum paid or payable by way of pension, benefit or allowance under any law of the Commonwealth or the State or under the law of any other State, territory or country, or a gratuity, whether paid or payable to the estate or to a person for whose benefit the action is brought. Section 19(2) says that, in an action commenced on or after the commencement of the Wrongs (Remarriage Discount) Act 2004, no separate reduction may be made for the remarriage or formation of a domestic partnership, or the prospects of either, of the surviving spouse or domestic partner or a surviving former spouse or former domestic partner. Section 19 defines domestic partner and spouse for that purpose.
- Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Victoria: assessment of a Part III Wrongs Act 1958 action

**Deliverable**: A dependency table with receipts marked ignore or not, and no final award.

**Inputs**

- Wage and support records selected by the lawyer
- The opened damages section
- Scheme payments already on the file

**Example**: Illustrative example: A surviving spouse may remarry. The action was commenced after the 2004 Act. The tool leaves the remarriage row with no discount. The lawyer does not add one.

**Stop and escalate when**

- The commencement date of the action is unknown and section 19(2) is being applied.
- A final percentage is inserted.

Checked 2026-10-23.
