| How AI is used | In a firm-controlled tool, row each family member's support and mark a sum section 70 says must not reduce the damages. Leave tax, any discount rate, and a new relationship for the lawyer. |
| What the lawyer must review | Set the dependency. Do not award a figure. A future relationship of a spouse is ignored. A relationship already entered is for you to assess under section 67. Apply 5 per cent only if section 61 applies and no rate is prescribed. You decide whether it applies. |

## Checking plan

**Queensland disregard list and relationships**

The tool rows support and marks sections 67, 68 and 70. The lawyer decides tax, any discount rate, and a relationship already entered.

- What the AI does: In a firm-controlled tool, row each family member's support and mark a sum section 70 says must not reduce the damages. Leave tax, any discount rate, and a new relationship for the lawyer.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Mark the section 70 list, and no other receipt, as not taken into account.
2. Keep a spouse's future relationship blank. If a new relationship already exists, row benefits received and likely, without assuming it continues.
3. Do not reduce a child's damages because a relationship with the surviving parent ended, or because of benefits from someone other than the deceased.
4. Leave section 60 tax and the section 61 rate blank until you state them.

## Notes

- Section 70 of the Civil Proceedings Act 2011 says the Part 10 assessment must not take into account, to reduce the damages, an amount paid or payable on the death under a contract of insurance, under a contract with a friendly or benefit society, association or trade union, out of a superannuation, provident or similar fund, or by way of pension, benefit or allowance under a law of the Commonwealth, a State or another country, or a gratuity. Section 67 says the court must not take into account financial benefits the spouse may receive from a new relationship entered after the assessment, even if the spouse intends to enter one. If the spouse has already entered a new relationship, the court may take into account benefits received and likely to be received, but must not assume the relationship will continue or that the same benefits will continue. Section 68 says a child's damages must not be reduced because a relationship with the surviving parent ended before the death, and must not take into account financial benefits the child received or may receive from anyone other than the deceased, including from a new relationship of the surviving parent. Section 60 applies to a claim for personal injury, loss of dependency or wrongful dismissal, and requires damages based on deprivation or impairment of earning capacity, loss of earnings, or loss of future probable earnings, to be reduced by the income tax the court considers would have been paid. Section 61 states a 5 per cent discount only if no rate is prescribed, and only for an award to which it applies. It does not apply to an award to which chapter 3 of the Civil Liability Act 2003 applies. The lawyer decides whether section 61 applies to the dependency lump sum.
- Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland: assessment of a Part 10 Civil Proceedings Act 2011 proceeding

**Deliverable**: A dependency table with the statutory ignore list marked and no final award.

**Inputs**

- Wage and support records selected by the lawyer
- The opened damages section
- Scheme payments already on the file

**Example**: Illustrative example: A spouse intends to repartner but has not done so. The tool marks section 67(2) and inserts no discount. The lawyer does not assume a future relationship.

**Stop and escalate when**

- A 5 per cent discount is inserted before you decide that section 61 applies.
- A child's claim is reduced for a new relationship of the surviving parent.
