| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | In a firm-controlled tool, row each dependant's support and mark only a sum section 3(3) of the Compensation to Relatives Act 1897 says is not taken into account. Do not insert a remarriage discount or a consolidation figure. |
| What the lawyer must review | Set the dependency. Do not award a figure. Do not invent a remarriage or new-relationship direction. The opened sections state none. Use the workers compensation lump sum in force at the date of death, not a printed consolidation figure. |

## Checking plan

**New South Wales disregard list**

The tool marks only the section 3(3) sums. The opened Act states no remarriage direction. Workers compensation is a separate calculation.

- What the AI does: In a firm-controlled tool, row each dependant's support and mark only a sum section 3(3) of the Compensation to Relatives Act 1897 says is not taken into account. Do not insert a remarriage discount or a consolidation figure.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Mark insurance, superannuation or a like fund, a friendly society, benefit society or trade union benefit, and a pension under the named repealed Acts or an Act amending or replacing them.
2. Leave remarriage blank. The opened sections do not deal with it.
3. Keep Workers Compensation Act s 25 in a separate column, calculated at the date of death.
4. Do not copy a dollar figure from the consolidation.

## Notes

- Section 3(3) of the Compensation to Relatives Act 1897 says the assessment shall not take into account a sum paid or payable on the death under a contract of insurance, a sum out of a superannuation, provident or like fund or by way of benefit from a friendly society, benefit society or trade union, or a pension under the named repealed pension Acts or under any Commonwealth or State Act amending or replacing any such Act. The opened sections do not contain a remarriage or new-relationship direction. Section 25(1) of the Workers Compensation Act 1987 is a separate statutory lump sum and weekly payment for dependent children, apportioned among dependants, and section 25(4) says the lump sum is calculated by the amount in force at the date of death. The dollar figure printed in a consolidation is not that amount unless it is the amount in force at the date of death.
- Family, wage and medical records stay in a firm-controlled tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: New South Wales: assessment under the Compensation to Relatives Act 1897

**Deliverable**: A dependency table with the section 3(3) sums marked and no final award.

**Inputs**

- Wage and support records selected by the lawyer
- The opened damages section
- Scheme payments already on the file

**Example**: Illustrative example: The consolidation shows a lump sum death benefit. The tool refuses to copy it and rows section 25(4). The lawyer uses the amount in force at the date of death.

**Stop and escalate when**

- A remarriage percentage is proposed.
- A printed consolidation figure is used as the current death benefit.
