## Checking plan

**Verify against sources**

The lawyer decides the effect on the civil figures. The tool lists the components of the order.

- What the AI does: From the compensation order, list each component, the amount, whether it is personal injury or property, and whether anything has been paid. Do not decide that the civil claim is reduced.
- What the lawyer does: Decide how any amount the victim has received is brought to account.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Section 35(1)(c) is compensation for personal injury, including to a person who was not the victim of the offence. Subsections (1)(a) and (1)(b) are restitution and compensation for property. Keep them apart.
2. The order may be in addition to any other sentence. The opened section does not say it reduces a later civil claim.
3. The court-ordered payments page says a court may refer the order to the State Penalties Enforcement Registry to collect on behalf of the victim. Collection can be by instalments, and can be difficult. That page does not say the order reduces civil damages.
4. The guide's offender-debt recovery is the State asking a convicted offender to repay the State. Do not enter that figure as money the victim has received.

## Notes

- If the order has been referred for collection, record whether any amount has actually been paid to the victim. An unpaid order is not a receipt.
- Where there is more than one order, the court-ordered payments page says money collected is paid in the priority the court set.
- Health information in the order stays in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Penalties and Sentences Act 1992 (Qld) s 35, and collection of a court order

**Deliverable**: A component list of the order, with what has been paid. The lawyer decides the effect on the civil figures.

**Inputs**

- The compensation order
- Any record of payment or of a referral for collection
- Section 35

**Example**: Illustrative example: The order is $6,000 for personal injury and has been referred for collection. Nothing has been paid. The list shows $6,000 outstanding. It does not subtract $6,000 from the civil claim.

**Stop and escalate when**

- The order does not separate injury from property.
- There is no record of what the victim has actually received.
