| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | Index the reports, the diagnosis dates and the note of the plaintiff's health, with a document reference for each row. Write nothing that is filed. |
| What the lawyer must review | The lawyer decides whether an expedited trial is justified and writes the application. Use paragraph 6.4 for an expedited trial. The health point in paragraph 13.1 is a regional-circuit exception. A summons for directions is not needed once a notice of appearance is filed. Keep the reports in the firm tool under ASCR r 9, APP 11 and the Privacy Act 1988 (Cth). |

## Checking plan

**Lawyer-led judgement**

An expedited Dust Diseases List trial is sought on summons as soon as possible, and health can require a more urgent listing.

- What the AI does: Index the reports, the diagnosis dates and the note of the plaintiff's health, with a document reference for each row. Write nothing that is filed.
- What the lawyer does: The lawyer decides whether to seek an expedited trial and writes the application. The tool only indexes.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Paragraph 6.4: an expedited trial is sought on summons with supporting material, as soon as possible.
2. Paragraph 13.1 says regional proceedings are managed in the same way as other proceedings in any List, subject to stated exceptions. The trial will be listed in the relevant Supreme Court civil trial circuit unless a more urgent listing is required due to a party's state of health. That is not the expedited-trial rule in paragraph 6.4, and it is not a general urgent-listing power for every Dust Diseases List case.
3. The list page: once a notice of appearance is filed the Court issues the timetable, and a summons for directions is not needed. A summons may be returnable on a Friday, other than a non-sitting date on that page, more than 7 days ahead.
4. The list email is dust.diseases@supcourt.vic.gov.au. Other than expedited cases, paragraph 6.1 expects a trial within 12 to 14 months of notices of appearance, with mediation about 2 to 3 months before trial.

## Notes

- Practice Note SC GEN 25 was issued and commences on 14 May 2026. Do not enter confidential or sensitive information into a public AI tool. Evidence must be the person's own knowledge and words.
- Do not put a day count from any unopened timetable into the index.

## Practical guide

Jurisdiction: Supreme Court of Victoria, Dust Diseases List

**Deliverable**: An index of reports and dates, and the application written by the lawyer.

**Inputs**

- Medical reports
- Note of the plaintiff's health
- Whether a notice of appearance has been filed

**Example**: Illustrative example: The physician says the plaintiff may not survive to an ordinary trial date. The tool indexes the report and the date. The lawyer decides whether to seek an expedited trial under paragraph 6.4, and writes the application. Paragraph 13.1 is used only for a regional proceeding whose circuit listing is too slow because of health.

**Stop and escalate when**

- Nothing generated is placed in the application.
- The index gives a hearing date the Court has not fixed.

Checked 2026-10-23.
