## Checking plan

**Lawyer-led judgement**

The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

- What the AI does: In a firm-controlled tool, index the medical reports, the diagnosis dates and the lawyer's note of the plaintiff's condition, with a document reference for each row. The tool writes nothing that is filed.
- What the lawyer does: The lawyer decides whether an urgent hearing is justified and writes the application. Do not put a day count in the index. The timetable document was not opened. Reports stay in the firm tool. ASCR r 9, APP 11 and the Privacy Act 1988 (Cth) apply.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Confirm every report in the index has a date and a document reference.
2. Confirm nothing generated is placed in the application or the evidence.
3. Confirm no day count from the unopened timetable is in the index.
4. In Queensland, confirm the note says no specialist dust list was found.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Supreme Court of Victoria Practice Note SC GEN 25 was issued and commences on 14 May 2026. Do not enter confidential or sensitive information into a public AI tool. Evidence must be in the person's own knowledge and words.
- Queensland courts say not to enter private, confidential, suppressed or privileged information into a public generative AI chatbot. For submissions, lawyers follow Supreme Court Practice Direction 5 of 2025 or District Court Practice Direction 12 of 2025. Those directions were not opened beyond the courts page.
- The Dust Diseases Tribunal practice-notes index opened on 23 October 2026 has no generative AI note. Do not treat a Supreme Court generative AI note as the Tribunal rule. Do not enter confidential information into a public tool.
