## Checking plan

**Verify against sources**

The lawyer chooses what is claimed. The list records the WorkSafe gates and the gaps. It does not state a dollar figure.

- What the AI does: From the injury date, the body systems and any earlier assessment the lawyer marks, list the stability gate, the once-only rule and the documents still missing. Do not calculate the amount or choose the injuries.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The WorkSafe page says an impairment benefit is a lump sum, separate from any payment for lost income and from medical expenses. A benefit for a specific impairment can be received only once during the claim.
2. The injury or illness must be stable, usually at least 12 months after the injury date, and must be assessed by an independent impairment assessor under the guidelines specified in the legislation. The guidelines themselves were not opened.
3. Legal costs are not covered by WorkSafe. Impairment-benefit protocols allow a legal representative to be reimbursed and to be paid a fee for using them. The fee schedule on the page was not opened.
4. For hearing loss, the claims manual says the 10 per cent whole-person-impairment threshold need only be met once, and a later claim need not meet it again. An earlier Victorian hearing-loss dollar amount is deducted. The percentage is not deducted.

## Notes

- The tool writes nothing on the worker's claim for impairment benefits. The worker and the lawyer complete that form.
- The Act is in force as version 054, effective 2 October 2026. The threshold sections for impairments other than hearing loss were not opened. Do not add a percentage for those impairments.

## Practical guide

Jurisdiction: Victoria: a WorkSafe impairment-benefit claim

**Deliverable**: A checklist of gates and missing documents.

**Inputs**

- The injury date and whether the condition is stable
- Any earlier impairment benefit for the same impairment
- Hearing-loss history, if hearing is in the claim

**Example**: Illustrative example: The injury date is nine months ago and the condition is still changing. The checklist marks the usual 12-month stability gate as not yet met. It does not calculate a lump sum.

**Stop and escalate when**

- The checklist states a dollar amount.
- An impairment has already been paid and the checklist claims it again.
