## Checking plan

**Verify against sources**

The review policy, updated 24 August 2026, offers an informal review, the dispute-resolution protocols, and tribunal review. The informal review does not stop the 12-month period.

- What the AI does: Draft an informal-review request that identifies the decision, the date the client became aware of it, and the documents the lawyer has marked. Do not lodge a tribunal application.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. An informal review is free. A review manager, working independently of the claims area, conducts it. The request is made on the published form within 12 months of becoming aware of the decision.
2. A client may ask for a statement of reasons at any time. The informal review does not stop the 12-month period, counted from awareness, for the protocols or for tribunal review.
3. If an informal review and a protocol or tribunal application are both lodged, the review manager withdraws the informal review unless the tribunal application was lodged to protect the 12-month right.
4. A tribunal application is made within 12 months of becoming aware of the decision, or within 3 months of notice of the decision on a pre-issue review, whichever is last. A failure to decide a compensation claim within 21 days, where no further information was requested, or a denial, can be reviewed by the tribunal.

## Notes

- The dispute-resolution protocols apply to decisions made on or after 1 March 2005 where the lawyer is a member of the Law Institute of Victoria or the Australian Lawyers Alliance. A represented client may not apply to the tribunal unless a pre-issue review is completed, unless the client and the Commission both consent in writing.
- No tribunal generative-AI practice note was opened. If the dispute is later filed in the County Court, practice note PNCCV 1-2026 applies. If it is filed in the Supreme Court, Practice Note SC GEN 25 applies.

## Practical guide

Jurisdiction: Victoria. Informal review by the Transport Accident Commission, before any tribunal application.

**Deliverable**: A draft informal-review request identifying the decision and the marked documents.

**Inputs**

- The decision
- The date the client became aware of it
- The documents the lawyer has marked

**Example**: Illustrative example: The client became aware of a treatment denial six months ago. The draft asks for an informal review and records that the 12-month tribunal period is still running. The lawyer decides whether to protect that period.

**Stop and escalate when**

- The date of awareness is unknown.
- Twelve months from awareness have passed and the lawyer has not directed a late-request check.
