| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the institutions and years the lawyer has named, draft a request for complaint files, personnel records and placement records for those years only. Do not describe the abuse, and do not call the letter a notice of claim. |
| What the lawyer must review | The lawyer settles the letter. It is not the notice of claim. If that Act applies, the notice is a separate step. The time in s 9 was not opened. If the institution is unincorporated, address that notice to its head. Keep the file in the firm's system. Confidentiality and APP 11 apply. |

## Checking plan

**Verify against sources**

The institution receives the letter, so the lawyer settles it. The letter does not replace a notice of claim.

- What the AI does: From the institutions and years the lawyer has named, draft a request for complaint files, personnel records and placement records for those years only. Do not describe the abuse, and do not call the letter a notice of claim.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. If the Personal Injuries Proceedings Act 2002 applies, the respondent's duty to give documents sits in that Act. This task does not replace the notice of claim, and the time limit for the notice was not opened.
2. A notice of claim to an unincorporated institution is given to its head under Civil Liability Act s 33H(3).
3. The November 2022 guidelines do not set out a records protocol. They do say the State will help identify the proper defendant, which is often what the records are for. The guidelines do not bind the State.
4. The letter names institutions, people and years. It does not narrate the abuse.

## Notes

- Do not state a number of months for the notice.
- Do not ask for another child's records unless the lawyer has added that category.

## Practical guide

Jurisdiction: Queensland. A letter to an institution, kept separate from any notice of claim under the Personal Injuries Proceedings Act 2002.

**Deliverable**: A record request limited to the institutions, people and years the lawyer has named, marked as not the notice of claim.

**Inputs**

- The institutions and years the lawyer has named
- Whether the institution is unincorporated
- Whether the lawyer says the pre-court Act applies

**Example**: Illustrative example: The institution is unincorporated and the pre-court Act may apply. The draft asks for staff and complaint records for the years the lawyer named, and it is headed as a records request. The lawyer prepares any notice of claim separately, addressed to the head.

**Stop and escalate when**

- The letter is headed as a notice of claim.
- The draft states a time limit that was not opened.
