## Checking plan

**Verify against sources**

An intake letter before a complying part 1 notice asks the holder to keep records. It is not a demand under section 27.

- What the AI does: Draft a letter that asks the holder to keep the incident records the lawyer names. Do not say the holder must produce documents, and do not send the letter.
- What the lawyer does: The lawyer decides whether the letter is sent and whether a part 1 notice has become complying.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The letter asks the holder to keep the records the lawyer names. It does not say the holder must produce them.
2. Personal Injuries Proceedings Act 2002 section 27 applies to a respondent after a complying part 1 notice. It then requires copies of directly relevant documents then in the respondent's possession about the incident, about medical condition or rehabilitation, and about cognitive, functional or vocational capacity.
3. The time under section 27 is the prescribed period or, if none is prescribed, one month after the complying part 1 notice, and later material within seven days. Do not put those times in a letter that is sent before a complying part 1 notice.
4. If the claimant requires information to be verified, the respondent does the verification. The tool writes nothing in it, and this letter does not ask for it.

## Notes

- The regulation that may prescribe a period for section 27 was not opened. Do not invent a prescribed period.
- A letter the holder receives is checked by the lawyer on this matter before it goes out.

## Practical guide

Jurisdiction: Queensland, before a complying part 1 notice under the Personal Injuries Proceedings Act 2002

**Deliverable**: A draft letter, still unsent, asking the holder to keep named records.

**Inputs**

- The holder and the records the lawyer names
- Whether a complying part 1 notice has been given

**Example**: Illustrative example: The draft asks a shop to keep the incident report. The lawyer deletes a sentence that said the shop must produce it, because no complying part 1 notice has been given.

**Stop and escalate when**

- The draft says the holder must produce documents and the lawyer has not inserted section 27.
- A complying part 1 notice has been given and the task has become a section 27 request.
