| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | Once the lawyer has stated an injury scale value and the financial year in which the injury arose, set out the base amount and the variable amount from the indexation notice for that year and add them under Civil Liability Act s 62. For an injury arising in the 2026-2027 year, use the Civil Liability Indexation Notice 2026. Do not choose the injury scale value. |
| What the lawyer must review | The lawyer assesses the injury scale value from 0 to 100 under s 61. Use the notice for the year the injury arose, not a later notice by default. Stop if s 5 excludes the Act, including most work injuries and dust-related conditions. The lawyer writes any damages schedule that will be served. |

## Checking plan

**Verify against sources**

Queensland general damages are an injury scale value converted by the indexation notice, not a percentage of a most extreme case.

- What the AI does: Once the lawyer has stated an injury scale value and the financial year in which the injury arose, set out the base amount and the variable amount from the indexation notice for that year and add them under Civil Liability Act s 62. For an injury arising in the 2026-2027 year, use the Civil Liability Indexation Notice 2026. Do not choose the injury scale value.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Confirm the injury arose after 1 December 2002, as s 61 and s 62 require.
2. Confirm s 5 does not take the injury outside the Act.
3. Select the notice row for that injury scale value and show the base and variable amounts.
4. Do not apply the 2026-2027 figures to an injury that arose in an earlier year.

## Notes

- The Civil Liability Indexation Notice 2026 commenced on 1 July 2026, fixes the amounts for the 2026-2027 financial year, and repeals the 2025 notice. Section 62(4) uses the notice for the period in which the injury arose.
- For an injury scale value of more than 10 and not more than 15, the 2026 notice states a base of $21,850 and a variable amount of (injury scale value minus 10) times $2,770. Other rows are in the same notice.
- If the product is used in a Supreme Court submission, Practice Direction 5 of 2025 requires the named practitioner to verify every reference. District Court Practice Direction 12 of 2025 is the matching direction opened for that court.

## Practical guide

Jurisdiction: Queensland court assessing general damages under Civil Liability Act 2003 chapter 3

**Deliverable**: A general-damages workings sheet from the lawyer's injury scale value and the matching notice.

**Inputs**

- Injury scale value assessed by the lawyer
- Date the injury arose
- The indexation notice for that financial year
- Confirmation that s 5 does not exclude the injury

**Example**: Illustrative example: The lawyer assesses an injury scale value of 12 for an injury in August 2026. The sheet uses the 2026 row for a value of more than 10 and not more than 15. It does not change the 12.

**Stop and escalate when**

- The injury is a work injury within s 5(1)(b), or a dust-related condition within s 5(1)(c).
- The lawyer has not assessed the injury scale value.
- The financial year of the injury is unknown.

Checked 2026-10-23.
