## Checking plan

**Verify against sources**

The lawyer advises the worker. The table records that the impairment benefit is a separate lump sum. It does not say the worker should accept.

- What the AI does: From the assessment, the payment history and the proposal, table the impairment-benefit conditions the WorkSafe page states. Do not advise the worker to accept, and do not write an agreement.
- What the lawyer does: The lawyer makes the legal assessment, checks the source material and authorises the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The WorkSafe page says the impairment benefit is separate from any payment for lost income and from medical expenses. A benefit for a specific impairment can be received only once during the claim.
2. The injury must be stable, usually at least 12 months after the injury date, and assessed by an independent impairment assessor. The page does not describe the benefit as bringing weekly payments to an end.
3. No section that redeems or buys out weekly payments was opened. Do not add one. Weekly payments continue or end under their own provisions, which are a separate question.
4. Legal costs of an impairment-benefit claim are not covered by WorkSafe, unless the impairment-benefit protocols apply. The fee schedule was not opened.

## Notes

- The Act is in force as version 054, effective 2 October 2026. A redemption or commutation section was not found in the pages opened for this task.
- If the advice is later put into a court document, the lawyer writes that document and verifies it under the practice note of the court.

## Practical guide

Jurisdiction: Victoria: a WorkSafe impairment benefit, considered beside ongoing weekly payments

**Deliverable**: A conditions table. The lawyer advises the worker.

**Inputs**

- The assessment and whether that impairment has already been paid
- The weekly-payment position
- The proposed amount, if any

**Example**: Illustrative example: The proposal is described as ending weekly payments in exchange for the impairment sum. The table records that the opened page keeps the impairment benefit separate from lost income and does not describe it as ending weekly payments. The lawyer advises. The table does not.

**Stop and escalate when**

- The table advises the worker to accept or reject the proposal.
- The table states that weekly payments will end because an impairment benefit is paid.
