## Checking plan

**Verify against sources**

The tool lists figures and missing figures. The lawyer writes the opinion and the material rule 98 requires.

- What the AI does: List the figures the lawyer has accepted, and the gaps, for a sanction of a compromise for a child or a person under a legal disability. Write none of the opinion and none of the solicitor's material under rule 98.
- What the lawyer does: The lawyer writes the opinion, the reasons, and anything placed before the court.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. The District Court checklist, which follows the same sanction, says the court should ordinarily be given an advice from a barrister or an independent solicitor, material from the litigation guardian, material from the plaintiff's solicitor, a separate costs estimate, material from the administrator or trustee, and a draft order. The tool writes none of those documents.
2. The advice, where the lawyer writes it, covers liability, damages and why the settlement is for the benefit of the person. The tool does not write that explanation. It lists only whether the lawyer has supplied a liability view, a likely-award range, and the reason.
3. Practice Direction 15 of 2018 paragraph 12: the solicitor's supporting material includes estimates of standard costs, indemnity costs, and the difference the plaintiff will pay from the compromise sum. Record those figures only if the lawyer supplies them.
4. The deliverable is the list of figures and gaps. It is not an advice, not a letter, and not a document for the court.

## Notes

- Rule 98(2)(a) requires an affidavit by the party's solicitor stating why the compromise is in the party's best interests. The tool writes nothing in it. The same bar applies to the litigation guardian's statement.
- This stays an internal list. If the task becomes the opinion, stop.
- Health, wage and settlement material stays in a firm-controlled tool. Apply ASCR r 9 and APP 11, and consider whether a breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: Queensland sanction of a compromise for a child or a person under a legal disability

**Deliverable**: A list of the figures the lawyer has accepted and the gaps that remain. No opinion and no solicitor's material.

**Inputs**

- The figures the lawyer has accepted
- The gaps the lawyer identifies

**Example**: Illustrative example: The list shows a compromise sum and a blank for the indemnity-cost estimate. It does not explain why the compromise is in the person's interests.

**Stop and escalate when**

- The draft states why the compromise is in the person's interests.
- The draft writes the opinion or the solicitor's material.
