## Key facts

| Fact | Value |
| --- | --- |
| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Red: Lawyer writes; AI may check, clarify or collect data |
| How AI is used | In a firm-controlled tool, list only the settlement figures, the refund schedule and any manager's fee estimate, each with its source. The tool writes nothing of the advice, nothing of an outline of it, and nothing that goes into an affidavit or an opinion. |
| What the lawyer must review | The lawyer writes the advice, any opinion and any affidavit. The tool writes nothing in them. The lawyer decides whether acceptance is in the person's interests. The lawyer checks every figure against its source before it is used. |

## Checking plan

**Lawyer-led judgement**

The lawyer makes the interests judgement and writes the advice. The tool's only output is a sourced list of figures.

- What the AI does: In a firm-controlled tool, list only the settlement figures, the refund schedule and any manager's fee estimate, each with its source. The tool writes nothing of the advice, nothing of an outline of it, and nothing that goes into an affidavit or an opinion.
- What the lawyer does: The lawyer writes the advice, any opinion and any affidavit. The tool writes nothing in them. The lawyer decides whether acceptance is in the person's interests. The lawyer checks every figure against its source before it is used.
- Who reviews: Responsible lawyer with competence in the matter
- Basis: Practical workflow informed by the linked primary sources; the traffic light and working checks are editorial guidance, not a court classification.
- Why: The level reflects what the work is, the consequence of an error, and how much of the output the lawyer must independently re-derive.
- Restriction: The lawyer makes the substantive assessment. Any permitted AI assistance remains supporting work with its own checks.

## Checks the lawyer makes

1. Confirm each figure on the list has a source document, and that the tool has added no conclusion.
2. Confirm the advice, the opinion and any affidavit are in the lawyer's words, with no generated passage left in them.
3. Apply Practice Note SC GEN 25 paragraphs 6.10 to 6.12 and Practice Note SC Gen 23 paragraphs 10 to 13 to any affidavit.
4. Record the management-cost estimate beside the document that states it, and leave adequacy to the lawyer.

## Notes

- These are suggested working checks. Confirm the required checking with the responsible lawyer before work starts; the checking approach does not establish permission to use AI.
- Health, wage and capacity records stay in a firm-controlled tool. The lawyer checks confidentiality under the conduct rules that bind the firm, whether the firm is an APP entity, Australian Privacy Principle 11 on security and destruction, and whether a loss would be notifiable under the Privacy Act 1988 (Cth). The serious-harm threshold page was not opened.
- Practice Note SC GEN 25 commenced on 14 May 2026. Practice Note SC Gen 23 commenced on 3 February 2025. The Queensland courts page warns against a public chatbot. The tool writes no advice, no opinion and no affidavit.
