| How AI is used | In a firm-controlled tool, adapt the operative release to the parties, the claims released, the benefits that continue or stop, and the amounts that must be held, and mark where approval is still required before it binds. Leave Commonwealth compensation-recovery clauses to their own task. The tool writes nothing in a document that is filed. |
| What the lawyer must review | Settle every operative clause and confirm who can sign. Confirm whether approval is still required before the release binds a person under disability. Leave Medicare, Centrelink and NDIS recovery clauses out of this draft. |

## Checking plan

**Verify against sources**

The lawyer settles the release. A signature does not supply the Court's approval.

- What the AI does: In a firm-controlled tool, adapt the operative release to the parties, the claims released, the benefits that continue or stop, and the amounts that must be held, and mark where approval is still required before it binds. Leave Commonwealth compensation-recovery clauses to their own task. The tool writes nothing in a document that is filed.
- What the lawyer does: Make the legal assessment, check the source material and authorise the output for its intended use.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Where rule 15.08(1) applies, the compromise is not valid, so far as it relates to the person under disability, without the Court's approval. A release signed before that approval does not supply it.
2. On a transport accident, use section 93 for exclusions and reductions. Do not state that section 53(2) ends a benefit. That subsection was not opened.
3. The TAC page says medical and like expenses generally continue. The lawyer decides what the release says about them.
4. No official release form was opened. The lawyer settles the operative words.

## Notes

- Rule 15.08(1) says a compromise in a proceeding is not valid, so far as it relates to the claim of a person under disability, without the approval of the Court. A release signed before that approval does not, on that rule, supply the approval. Funds in Court quotes the same subrule.
- Transport Accident Act 1986 section 93 is the opened exclusion and reduction for a transport accident. The TAC page says certain no-fault benefits cease once the claim is settled or damages are awarded, citing section 53(2), which was not opened, and that medical and like expenses generally continue, citing sections 60 and 93(10). For a workplace damages payout, section 343 is the opened reduction. The release records the section the lawyer names. It does not fill a gap with a section that was not opened. No official release form was opened.

## Practical guide

Jurisdiction: Victoria: a personal injury release adapted to the compromise and to approval

**Deliverable**: An operative release adapted to the agreed compromise, with approval and holding marked, and with Commonwealth recovery clauses left out.

**Inputs**

- The parties and the claims to be released
- Whether a person under disability is a party
- The benefits the lawyer says continue or stop

**Example**: Illustrative example: The release is for a child and a proceeding is on foot. The draft says it does not bind the child unless the Court approves, and it leaves Medicare clauses out. The lawyer settles every operative sentence.

**Stop and escalate when**

- The release would say that a signature is the Court's approval.
- The tool would add a Commonwealth recovery clause.
