## Checking plan

**Verify against sources**

The release follows the lawyer's terms. A signed insurer form is not a sanction under section 59.

- What the AI does: Adapt the release using only the terms the lawyer has written. Where a WorkCover form is to be signed, record what that page says the signature acknowledges, and record that the form does not replace a section 59 sanction. Do not send the release.
- What the lawyer does: The lawyer writes the terms, checks the release, and decides whether a sanction is still required.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Change the release only to the terms the lawyer has written. Do not add a bar, a confidentiality clause, or a payee the lawyer has not written.
2. The WorkCover page says that before payment the insurer needs a signed form. By signing, the worker acknowledges they will not be able to seek more money from the insurer or employer for that work-related injury, and that they will keep the settlement details confidential. The solicitor explains the form. No form number was opened.
3. Where the person is under a legal disability, that signed form does not replace the section 59 sanction, and section 59(1) still stops payment to the next friend or the solicitor unless the court directs.
4. The release is not sent until the lawyer has checked it. The tool does not have anyone sign it.

## Notes

- The Motor Accident Insurance Commission page says accepting a settlement finalises the claim so the person can no longer claim for injuries from that accident. Put that sentence in the release only if the lawyer writes it.
- A document the client or the insurer signs is checked on this matter.

## Practical guide

Jurisdiction: Queensland personal injury release of an agreed compromise

**Deliverable**: A draft release limited to the lawyer's terms, with a note where a signed insurer form does not replace a sanction.

**Inputs**

- The terms the lawyer has written
- Whether the lawyer says the person is under a legal disability

**Example**: Illustrative example: The draft uses the lawyer's releases and deletes an extra confidentiality sentence the tool had added. The note says the WorkCover form, if signed, is not the sanction.

**Stop and escalate when**

- The draft adds a term the lawyer did not write.
- The person is under a legal disability and the draft treats the signed form as the sanction.
