| Practice area | [Personal Injury & Compensation (workers compensation, CTP/TAC, medical negligence)](https://ailawframework.com/practice/personal-injury-and-compensation.md) |
| Human involvement | Yellow: Lawyer and AI draft together |
| How AI is used | From the plan, the supports since the injury and the proposed settlement, list the supports that relate to the injury and the settlement heads that may cover the same needs. The tool does not decide the effect on the plan or send the notice. |
| What the lawyer must review | The NDIA gives Transport Accident Commission and WorkSafe supports as examples of statutory-scheme compensation. Tell the NDIA of compensation received or a claim in progress. The plan can continue while the claim is open. The NDIA says it cannot replace a support the scheme already provides. The lawyer decides what that means here. Keep plan and medical records in a firm-controlled tool. Apply ASCR r 9, APP 11 and the notifiable-breach test. |

## Checking plan

**Verify against sources**

The lawyer decides how the NDIA compensation pages apply to the Victorian scheme supports and the settlement.

- What the AI does: From the plan, the supports since the injury and the proposed settlement, list the supports that relate to the injury and the settlement heads that may cover the same needs. The tool does not decide the effect on the plan or send the notice.
- What the lawyer does: Decide the effect on the plan, advise the participant, and settle any notice to the NDIA.
- Who reviews: Lawyer competent in this practice area
- Basis: Checked against the linked sources on 23 October 2026. Confirm the current instrument before reliance.

## Checks the lawyer makes

1. Treat ongoing Transport Accident Commission or WorkSafe supports as compensation where the NDIA page gives those schemes as examples. Do not add a scheme the page does not name.
2. List only supports that relate to the compensable injury, with the period and the amount from the plan or the scheme statement.
3. Match those supports to the settlement heads before the notice is sent. The lawyer identifies the heads.
4. Use the compensation information form the NDIA page describes. Check the page on the day of the notice.

## Notes

- The statutory-scheme page says the NDIA cannot replace or fund a support the scheme already gives, and that the plan is built to complement those supports.
- No compensation-reduction formula was opened. Do not calculate one.
- Keep health, wage and scheme records in a firm-controlled tool. Apply ASCR r 9 and APP 11, and consider whether any breach is notifiable under the Privacy Act 1988 (Cth).

## Practical guide

Jurisdiction: NDIS compensation notice where the participant has Transport Accident Commission or WorkSafe supports

**Deliverable**: A list of related supports and overlapping settlement heads, for the lawyer's notice.

**Inputs**

- The current NDIS plan and funded supports
- Transport Accident Commission or WorkSafe support statements
- The proposed settlement heads

**Example**: Illustrative example: The plan funds attendant care and the Transport Accident Commission also funds attendant care. The list shows both periods. The lawyer decides what to tell the NDIA and whether the settlement heads cover the same need. The tool does not send the form.

**Stop and escalate when**

- The plan or the scheme statement is missing.
- The list states an amount the NDIA will recover.
